Malem Seña in “¿Puede las malas personas ser buenos jueces?” analyzed the judicial morality. At first time from a historical analysis, the judges were not required to base their judgments, because they were the mirror of legitimacy and morality of their decisions. With the advent of rationalism and modern State, the sentences should be the foundation. The situation that put the judge person in the background. In this situation, the answer to the question posed in the job would be: "Yes, (...)

In this paper, we analyze the origin of the links between global bioethics (which we differentiate from biomedical bioethics) and human rights. We understand that we are in a global civilizational crisis, whose roots extend to 1492 today, in which the modern-capitalist model used the discourse of human rights to justify its predatory technocracy. There are three theoretical assumptions that support our analysis: 1) The current conditions in which the technique shows its destructive power over nature (Anthropocene) indicate that none (...)

A secondary aim is to review assessment tools that have been developed to prevent biases in AI systems. In addition, we provide a conceptual clarification for some terms related to biases in this particular context. We focus mainly on nonracial biases (...)

There is a close relationship between education and citizenship. Liberal political theorists tend to spend much of their work justifying the role of educational institutions in political communities. However, the development of these proposals is usually thought for subjects who do not have disabilities, arbitrarily excluding a significant proportion of society. This not only happens at an educational level, it is replicated in various areas of social life. In this sense, in the present work I am going to propose that (...)

Whether Nietzsche’s genealogical critique of morality is best understood as an internal or as an external critique remains a matter of controversy. On the internalist interpretation (Ridley, Owen, Merrick ), the genealogical enterprise takes as its starting point the perspective being criticized, gradually revealing it to be untenable ‘from within.’ On the externalist interpretation (Leiter, and arguably Geuss, Williams, and Janaway ), this constraint is lifted; the starting point of the critique need not be the perspective being criticized, but may (...)

On the Logic of Values.Manuel Dries - 2010 - Journal of Nietzsche Studies 39 (1):30-50.
This article argues that Nietzsche’s transvaluation project refers not to a mere inversion or negation of a set of nihilism-prone, Judeo-Christian values but, instead, to a different conception of what a value is and how it functions. Traditional values function within a standard logical framework and claim legitimacy and “bindingness” based on exogenous authority with absolute extension. Nietzsche regards this framework as unnecessarily reductive in its attempted exclusion of contradiction and real opposition among competing values. I propose a nonstandard, dialetheic (...)

  41. Working Retirees? A Liberal Case for Retirement as Free Time.Manuel Sá Valente - 2024 - Ethical Theory and Moral Practice 27 (4):523-537.
Retirement is often viewed as a reward for a working life. While many have reason to want a work-free retirement, not everyone does. Should working retirees have to give up their retirement pension and, consequently, their status as retirees? The answer, I argue, boils down to whether we conceive of retirement as free time (need-free) or as leisure (work-free). In this article, I put forward a liberal case in favour of free time, despite whether our liberalism leans towards perfectionism or (...)

  42. Bentham and Mill on the "Quality" of Pleasures.Francisco Vergara - 2011 - Revue d'Etudes Benthamiennes 9 (2011):web.
John Stuart Mill and Jeremy Bentham are often said to have held opposed views concerning the way “the value” of different pleasures should be estimated. Mill is accused of being an inconsistent utilitarian because he thought that, when comparing the value of two pleasures, we should not forget to take their “quality” into account. Bentham, on the other hand, is said to have believed that we should take “only quantity” into consideration. By verifying what they actually wrote, and reflecting on (...)

The history of humankind is full of examples that indicate a constant desire to make human beings more moral. Nowadays, technological breakthroughs might have a significant impact on our moral character and abilities. This is the case of Virtual Reality (VR) technologies. The aim of this paper is to consider the ethical aspects of the use of VR in enhancing empathy. First, we will offer an introduction to VR, explaining its fundamental features, devices and concepts. Then, we will approach the (...)

  44. Pluralismo en torno al significado de la muerte cerebral y/o revisión de la regla del donante fallecido Pluralism about the meaning of brain death and/or the revision of the dead donor rule.David Rodríguez-Arias Vailhen & Alberto Molina Pérez - 2007 - Laguna 21.
Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...)

  45. What’s the Relationship Between the Theory and Practice of Moral Responsibility?Argetsinger Henry & Manuel Vargas - 2022 - Humana Mente - Journal of Philosophical Studies 15 (42):29-62.
This article identifies a novel challenge to standard understandings of responsibility practices, animated by experimental studies of biases and heuristics. It goes on to argue that this challenge illustrates a general methodological challenge for theorizing about responsibility. That is, it is difficult for a theory to give us both guidance in real world contexts and an account of the metaphysical and normative foundations of responsibility without treating wide swaths of ordinary practice as defective. The general upshot is that theories must (...)

The present article studies the epictetean philosophical use of some passages of the Greek and Roman history. The concepts of love-friendship (philía) and personal con- venience (sumphéron) second the philosopher to explain why happiness (eudaimonía) has not been reached by the human being in all history. All historical war or strife (pólemos), such as the Trojan, the Medics and the Peloponnesian wars, is provoked by epistemological-moral mistakes derived from the ignorance of which is the correct place to put the sumphéron; (...)

  49. Ageing as Equals: Distributive Justice in Retirement Pensions.Manuel Sá Valente - 2022 - Dissertation, Université Catholique de Louvain
Despite being increasingly available to us all, retirement pensions remain unequally distributed: between rich and poor, young and old, men and women, and possibly different generations. As this topic receives little attention in moral and political philosophy, the articles in this thesis aim to deliver an original account of justice in retirement pensions along liberal egalitarian lines. The first part defends retirement pensions as a distribution of free time. It shows that including free time in the list of goods that (...)
